Macs Adventure Booking Terms
& Conditions
Our booking terms and conditions are here to ensure that both parties
are completely clear on their responsibilities under this contract
and to comply with all the relevant legislation. They are most
easily understood in terms of your responsibilities (The Client)
and our responsibilities (Macs Adventure).
Your responsibilities:
1 – Payment for your holiday.
You are required to pay a 20% deposit when you book in order to
secure your holiday booking. The outstanding balance is payable
6 weeks prior to your departure date. If you book less than six
weeks prior to departure we require full payment on booking.
2 – Payment Methods
We accept payment by debit card, credit card, cheque, cash and
bank transfer in GBP. If you choose to settle your holiday balance
by credit card a handling charge of 2% on the outstanding balance
is made. There is no charge for other payment methods or for
payment of your deposit by credit card.
3- Cancellation
If you need to cancel your adventure for any reason you must inform
us in writing. Your date of cancellation is the date on which
we receive written cancellation.
You will be responsible for cancellation fees based on the cancelled value
of the holiday (or part of holiday) as follows:
• Less than 14 days prior to departure or during the tour/activity: 100%
of the total cost
• Between 15 and 28 days prior to departure: 50% of the total cost
• More than 28 days prior to departure: 20% of the total cost.
4- Amendments
1 – If you wish to change the details of your booking (such
as changing your date of departure, itinerary or room type) or
wish to cancel an optional extra we will do our best to help. We
charge an “Amendment Fee” to cover the costs of making
a change to your booking. If you make the change more than 42 days
before departure the amendment fee will be £35 per person.
If you make the change less than 42 days before departure the amendment
fee will be £50 per person.
2 – If the number of people in your group changes we will
recalculate the total cost of your holiday based on the revised
number of people travelling. This may increase if the room allocation
or type of room changes as the cost of rooms does vary.
5- Travel insurance
We strongly recommend that you purchase Travel Insurance to cover
yourself for the duration of your holiday with Macs Adventure.

Non-UK Residents: We are unable to recommend a provider for non-UK
residents and suggest that you contact a provider in your country
of residence.
6 – Suitability
All our holidays, tours and courses are graded and it is your responsibility
to ensure that you are physically fit, adequately experienced
and suitably equipped to compete the activity. If you or we decide
that you are unable to continue you will be responsible for making
your own alternative arrangements. If you have and medical conditions,
allergies or special dietary requirements you must inform us
and/or your leader (where appropriate).
7 – Complaints
Should you have any problem or complaint while on your adventure
you must bring it to our attention as soon as possible. If it
is not remedied to your satisfaction at the time please write
to us giving full details and we will endeavour to resolve the
issue. Please note that Scottish Law covers any disputes.
8 – Acknowledgement of Risk
1- I am aware that walking, mountaineering, cycling and mountain
biking involves the possibility of injury or death.
2 - I accept these risks and all others arising from this course,
tour, holiday or program, even if arising from the negligence or
gross negligence of anyone involved in any way with Macs Adventure.
3 - I understand that although Macs Adventure will ensure the program
is as safe as possible the SOLE RESPONSIBILITY FOR MY PERSONAL
SAFETY REMAINS WITH ME. I have made a realistic assessment of my
capabilities and am undertaking a mountain bike course, holiday
or tour which is suitable for my mountain biking skills and fitness.
4 - I am prepared for the worst possible conditions and understand
that the route may pass through very isolated areas which are exposed
to serious weather.
5 – If applicable I have checked my mountain bike or equipment
thoroughly and the equipment I am using, either hired or my own,
is suitable for the tour and in a sound condition. I understand
that maintaining my equipment in a sound and safe condition is
my sole responsibility.
Our responsibilities:
9 - Brochure Accuracy:
We will supply an activity or holiday which as close as possibly
matches the description given any written communication, brochure
or website. We believe it is correct at the time of publication.
We reserve the right to make changes and where applicable you will
be advised before the booking contract is concluded.
10 - Holiday Changes & Amendments:
If we have to alter your holiday arrangements the change will either
be minor or major. A major change would include a change of departure
date, a change in accommodation for more than 50% of nights booked,
a downgrading of accommodation grade or a material change to
the itinerary. If we make a major change we will advise you in
writing as soon as possible and you have the choice of accepting
the alternative offered or cancelling your booking at no charge
and all monies paid will be refunded to you. If the change is
minor (all changes apart from those defined above) we will inform
you as soon as reasonably possible but as the holiday us materially
unchanged this confers no right to cancel or compensation.
11 - Total Payment Protection (topp) Policy cover:
In compliance with the UK Package Travel, Package Holidays and
Package Tours Regulations 1992 an insurance policy has been arranged
with Travel & General Insurance Company plc to protect customers’ prepayments
paid in respect of
• non-flight inclusive packages commencing and returning to the UK
• the ground handling aspects of packages where the customer is responsible
for arranging travel to the destination
offered in this brochure/literature/document/on this website (subject
to the terms of the insurance policy), for: [delete as appropriate]
• a refund of such prepayments if customers have not yet travelled
• making arrangements to enable the holiday to continue if customers
have already travelled or
in the unlikely event of our financial failure.
12 - Holiday Cancellation by Macs Adventure:
If for any reason Macs Adventure has to cancel a tour or activity
you have two options, we will either refund you any monies paid
or provide an alternative tour/activity of similar or higher
standard. If we do cancel a tour we will inform you at the earliest
possible date. We will not cancel a holiday or course involving
an overnight stay less than 28 days prior to arrival or a course
or tour not including accommodation less than 7 days prior to
arrival. Macs Adventure will not be held liable for any additional
financial loss incurred as a result of cancellation.
13 - Macs Adventure Leaders:
Where applicable our leaders are experienced and trained in the
roles that they perform. They are there to ensure that you have
a safe and enjoyable adventure so any instructions must be adhered
to.
14 - Complaints:
If we receive a complaint we will respond within seven days and
aim to resolve any points raised in a speedy manner and in accordance
with best practice.
15 - Privacy Policy:
We respect your privacy and all personal information is stored
and processed in accordance with our privacy policy. We will
not pass on personal information for any reason apart from organising
your adventure.
16 - Duty of Care:
Macs Adventure recognises that it has a duty of care to its clients
and staff but cannot be held liable for any injury, illness or
loss not caused by Macs Adventure or its employees.
